Appeal/unfair warning

Ok here it is:

Part I: I got warned for "homosexual slur" in my pole by "Nicodemus." i beleive this is unfair because, in my opinion, this isn't "homosexual slur" nor was it intended to be. I said "screw this motherf****** $hit" The * and $ were put in by me, not by the gamewinners filtering thing i have seen before.

Part II: And, of course, (like on judge judy and stuff) i am "counter-sueing" "Nicodemus." for racism.
<---- in this thing he has "Hates Nintendo because they're Japanese" I am Japanese american and i beleive that this is racism.

I see no homosexual slur... It's kind of uneccessary for a poll choice, but there's no homosexual slur... I don't see it as a minority slur either.

I would also say that CT is a bit racist.

I removed the homosexual slur instead of closing the entire thread. The warning will stand and if you do it again, i'll have you permanatly blocked from Console Combat.

Now about this counter-suit.. I don't see how you think you can counter-sue me when you're the one suing me the first place.. if you launched a counter-suit, you'd be suing yourself.

Besides, it isn't racist to hate a company.. I didn't say I hated the Japanese, I said I hated Nintendo. While they may have spawned a race of idiots, Nintendo itself is not a race.

I'm sure when Crazy Jaime gets to this thread, he'll know why my CT says what it does.

BTW, sure hope you didn't go double or nothing with your friend on this poll cause it isn't looking too good for you.

Much as I agree with the warning, Nico, if your CT said 'Hates [african company] because they are black' it would be more obviously racist. Whereas they aren't quite the same, the same principal applies.

This is quite straightforward, so I'll offer a full explanation on all counts.

1) As stated by Nicodemus, your poll option originally included the word 'gay' which, in the context of its use, was very much a homosexual slur. Just because Nico edited it out in order to keep the thread open it does not mean that it suddenly did not exist. In fact, he did as a favour to you so that your thread could remain open. It could have just closed it. Therefore the warning very much still stands.

2) The explanation for Nico's CT is also straightforward. A member called 'Nintendo-Fanboy' (who has now been banned) made this thread (http://forums.gamewinners.com/forums/showthread.php?t=411759) in Console Combat in which he argued that Nintendo were failing in the console market because they are Japanese, and that people were deliberately not buying their products because they are Japanese. The thread was entitled "Nintendo: hated because they are Japanese". This was clearly a ridiculous argument, and Nico's CT is in response to this. Therefore the purpose behind the comment has nothing to do with race at all, and is not racist.

3) Furthermore, the post that you (Fork_of_Death) posted in your thread telling people to come to this thread could well be considered SPAM. If this is the case it will be your second warning, which will warrant a forum block. If that happens do not come running back here to complain about it.

4) You can only countersue someone when you yourself are being sued by them. Therefore you cannot in any way 'countersue' here. What's more, you cannot sue someone for racism that was supposedly aimed at a company that you have no part in. If you are going to sue someone for something, it must be an act that had a significant negative effect upon yourself. Even if Nico had been racist here, it would have had nothing to do with you no matter how much 'offense' you claim to have taken from it. Therefore you couldn't sue him no matter how much you may have wanted to.
